PRIVACY POLICY

Introduction

Coco Fitness Inc. (“Coco Fitness”, “we”, or “us”) respects the privacy of individuals and is committed to protecting the information of individuals that register to use the products and services through the mobile app (“customers", “users” or "you"). This Privacy Policy describes the ways we collect, use, retain, disclose and transfer information. Our Privacy Policy applies whenever you use our mobile app product or services (collectively, the “Product”). If you do not agree with the below policies and practices, your choice is not to register to use the Product through our mobile application.

Please read the Privacy Policy carefully and retain it for future reference. If you have any questions or concerns, please contact Marie-Claude Saulnier at mc@cocofitness.ca. It is Coco Fitness’ policy to comply with provincial and federal legislation. 

1.  Personal Information We Collect and How We Collect It

We process personal data, personal health information, and information from your smartphones and connected devices. The sources of the data are our smartphone application, your smartphone sensors and analytics and connected health devices.

Personal Information used for communications. Coco Fitness collects and maintains different types of personal information in respect of individuals with whom it interacts in order to provide its services for the Product. When you register to become a user of the Product, we may collect contact and identification information such as your name, email, as well as unique identifiers including your username, account number and password.

Personal Information used for Billing. For your security, Coco Fitness uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use billing information except for the sole purpose of credit card processing on our behalf and we do not have access to, nor do we store, your full credit card information.

Personal Information Used for Customizing Health and Fitness Services. Through the use of the Product, we may also ask users to share their iOS Health app data with our services, that data is covered by the Privacy Policy. We handle all iOS Health app and HealthKit data in accordance with Apple's development guidelines.

Through the use of the Product, we may also ask users to share their Google Fit data with our services, that data is covered by the Privacy Policy. We handle all Google Fit data in accordance with Google’s development guidelines.

Limits to the Collection of Personal Information

The amount of personal information collected by us shall be limited to what is deemed necessary and relevant for the Product to function or for reasonable business purposes identified by Coco Fitness. In no event will Coco Fitness make use of the personal information collected for any other purpose without first obtaining your consent except as otherwise permitted by legislation or regulation. 

2.  Usage of Personal Information

Coco Fitness may use the personal information in order to:

·  to create and update your account; verifying identity and for enabling communications with you about your account or to assist you when you contact our customer support services.

·  to process or facilitate payments for our Product's services and for the purposes of verifying identity and helping Customers with billing support questions; or

·  use the data such as weight, activity, sleep, food habits and state of mind to help in determining your health habits for providing coaching and dynamic workout plans personalized for you. Users can choose not to provide this additional information by not entering it when asked.

3.  Disclosure of Information.

Coco Fitness will only disclose your personal information for the purposes enumerated in the Privacy Policy or for any additional purposes for which we have obtained your consent to the use or disclosure of your personal information. 

We may collect, use or disclose your personal information without your knowledge or consent where we are permitted or required to do so by valid legal process, and/or applicable law and/or regulatory requirements.

Consent. It is important to us that when we collect, use or share your personal information we have your consent to do so. It is always your choice whether or not to provide us with personal information. However, depending on the sensitivity of the personal information, your consent may be implied, deemed or express. Express consent can be given orally, electronically or in writing. Implied consent is consent that can reasonably be inferred from your action or inaction. By using the Product and by providing any personal information, we will assume that you voluntarily accept and consent to our collection, use, retention, disclosure and transfer of your personal information in accordance with the terms of the Privacy Policy for purposes related to legitimate business needs. 

You may change or withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. All communications with respect to such withdrawal or variation of consent should be in writing and addressed to Marie-Claude Saulnier at mc@cocofitness.ca. In some circumstances, a change in or withdrawal of consent may severely limit Coco Fitness’ ability to provide the Product to you. Please note that your personal information processed prior to your request may not be deleted from our records but will be blocked from further processing without your permission. A request to revoke consent or block processing of your personal information may not apply to information collected by cookies or used internally to recognize you and/or facilitate your use of the Product, or information we may keep to comply with legal requirements.

Cookies and Third Party Technologies. We also collect certain information automatically from users of the Product, such user activity in the Product, and device information. This information is logged to help deliver a better user experience (for example, by displaying personalized content to you based on your interactions with the Product), to diagnose technical problems, to support marketing activities and so that we may better administer the Product in order to constantly improve the quality of the Product.

We may also allow others to provide audience measurement and analytics services for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify your device when you use the Product. 

Protection of Your Information. We use appropriate administrative, technical, organizational, and physical security measures to protect our users' information and data against accidental or unlawful destruction, loss, and alteration, and against unauthorized disclosure and access. We use standard industry practices to protect user information. Unfortunately, no data transmission or storage can be guaranteed to be 100% secure. While we strive to protect your personal information, we cannot guarantee security of the information you transmit to us or host with us using our Product.

Accessing and Updating Contact Information. We encourage our users to access, update and edit their contact information and keep it current. Users can easily access, correct or update their contact information at any time by logging into the Product and visiting the “account” tab on the dashboard. 

You have the right to access, correct, update or request the block processing of the personal information that we collect about you. Please send such requests to Marie-Claude Saulnier at mc@cocofitness.ca. 

International Data Transfers. Users' information may be transferred to, and processed in, countries other than the country in which they reside. Specifically, the Product is hosted on servers located in Canada, and our third party service providers and partners may operate around the world. This means that when we collect users' information, such information may be processed in any of these countries.

Data Retention. We will not retain your data for longer than is necessary to fulfil the purpose for which it is being processed. To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal information, the purposes for which we process it, and whether we can achieve those purposes through other means. When we have no ongoing legitimate business need to process your personal information, we will either delete it, destroy it or anonymize it. 

Contact Us about Complaints, Questions or Notices relating to this Privacy Policy. Coco Fitness commits to resolving complaints about your privacy and our collection, use or disclosure of your personal information. If you believe your privacy rights have been violated or you disagree with any action we have taken with regard to your personal information you may email Marie-Claude Saulnier at mc@cocofitness.ca. 

Revisions and Interpretation. Coco Fitness reserves the right to makes changes to the Privacy Policy from time to time without advance notice. Coco Fitness also reserves the right to interpret the Privacy Policy at its sole discretion. Any updated version of the Privacy Policy will be uploaded to the mobile app and any revision will be effective as of the date they are posted. In the event that your consent is required following any changes to Coco Fitness’ collection, use and disclosure of your personnel information, such changes will not be implemented until such consent has been obtained. 

The Privacy Policy is effective immediately and supersedes all prior versions.
